We Can Help

As unbelievable as it may seem, a large segment of American society still holds a negative view of mortorcyle riding and equate motorcylists with a gang subculture involving drugs and crime. Because of this negative stereotype, among other misconceptions, motorcyclists are routinely wrongly blamed and inadequately compensated for their injuries and damage to their motorcycles.

Active Motorcycle Accident Lawsuits

A lawsuit is more likely to result when a person is involved in an accident on a motorcycle than when involved in an auto vs. auto accident for several reasons. Given the significant injuries and damages suffered by the motorcyclist, there is a bigger incentive for the insurance companies to litigate when the damages are higher as it makes the cost of a lawsuit more justifiable and the returns potentially greater.

Selecting a Motorcyle Accident Attorney

Selecting an attorney to represent you is often a difficult decision. An attorney that you choose must have the skill, knowledge, experience and staff support to effectively represent you. However, those things are not enough. You should feel a personal connection with the lawyer. Empathy and compassion is not something that can be taught in law school or be faked. When you discuss your claim with an attorney, you will know if that person is the right attorney for you.

While riding a motorcycle is exhilarating, it is also very dangerous as the chances are great that you may be involved in a serious accident. The National Highway Traffic Safety Administration’s report from 2014 stated that motorcyclists are twenty-seven times more likely to be involved in a fatal accident than those traveling in passenger vehicles. In addition, motorcyclists are almost five times more likely to be injured in a crash. Moreover, the 2014 report claimed that more than 4,500 people were killed, and 92,000 motorcyclists were injured in crashes that year. A motorcycle accident can occur anytime and any place, but some common factors that cause and contribute to these accidents include driver error, driver distraction, driver inexperience, or speeding or alcohol was involved. Motorcycle Accident Causes and Other Statistics

The University of Southern California conducted a study in 2006 that analyzed factors that can cause or contribute to a motorcycle accident. The study examined approximately nine hundred accidents involving motorcycles that occurred in and around the Los Angeles area and observed about 3,600 motorcycle traffic accident reports. The results of the study showed that:

  • About three-quarters of accidents involving motorcycles also included another motor vehicle, and of these accidents, most of them happened because the driver of the other vehicle never saw the motorcycle, or by the time they did see the motorcycle, it was too late.
  • The motorcycle alone was involved in approximately one-quarter of the crashes, and in these accidents, the motorcycle usually collided with an object or the road.
  • Part malfunctions like flat tires cause only a small percentage of the motorcycle accidents.
  • Driver error caused accidents between a motorcycle and another vehicle in sixty-six percent of the incidents. Many of these errors included driving too fast or too wide on a curve, under-cornering, or over-braking that caused a slide-out and fall.
  • Motorcycle accidents tended to occur at intersections and usually when the motorcyclist was only out for a short trip.
  • Young motorcyclists between the ages of sixteen and twenty-four had a greater risk of being involved in a motorcycle accident, and women of all ages were at greater risk of being in an accident.
  • Motorcyclists and their riders were usually injured in the accident regardless of whether the accident involved just the motorcycle or multiple vehicles. Most of the injuries that motorcyclists and their riders sustained were serious.
  • Most motorcyclists and their riders who were fatally injured in an accident died because their heads or chests were injured in the crash. It’s important to note that by choosing to wear a helmet, you can really reduce your chance of a severe head injury.

While the 2006 study covers many factors that may lead to a motorcycle accident, it is not representative of every single factor that can cause or contribute to an accident. When you go out for a motorcycle ride, you are always putting yourself at risk, and even when you think you’ve done everything you can to try to prevent an accident or minimize injuries you can still be seriously injured. While feeling the wind on your face can be freeing, this feeling of freedom also makes you very vulnerable to serious accidents especially because there isn’t much protecting you from the road, objects, or other vehicles. However, one thing you can do to reduce the likelihood of a serious head injury is to wear a helmet. In fact, under Texas law, in certain circumstances, you are actually required to wear a helmet.

Motorcycle Accident Complications

The law is often misunderstood by police who often put the motorcyclist at fault when in fact the motorcyclist is not at fault or the police officer is biased against the motorcyclist for one reason another. Also, often the motorcyclist is transported to the hospital before the a police officer can speak to him so the officer may form an opinion without speaking to the motorcyclist or speaking to him last. Also, other factors come into play which can allow an insurance company to deny a claim. For example, a motorcyclist's experience and skill is often called into question when in reality it has nothing to do with the cause of the accident. Further, often the law is misapplied or misunderstood by the insurance company which can result in litigation or delay in resolving a claim.

There are issues unique to motorcycle accidents that can allow an insurance company to unreasonable including issues regarding motorcycle equipment, helmets, toxicology and a bias that often results in police reports that place blame unfairly on the motorcyclist.
