MARYLAND: Cases of E. coli Linked to Soy Nut Butter, Robins Cloud LLP Reports
Since the Centers for Disease Control and Prevention (CDC) notified the public earlier this week of its involvement in investigating a multi-state outbreak of E. coli O157, a source link has been discovered. On March 2, 2017, the Maryland Department of Health and Mental Hygiene (MDHMH) was the first of the local health departments to come forward with the link. There are currently 12 victims infected with E. coli bacteria that are genetically very similar to the confirmed Maryland E. coli O 157case. The agencies’ investigation is still pending, so additional cases may continue to arise.
“This emerging multi-state E. coli outbreak is especially concerning for two reasons. First, children are one of the highest risk groups for serious complications from E. coli, including hemolytic uremic syndrome (HUS). Children’s immune systems are still developing. And children are less able to fight off E. coli infections infections than adults. This SoyNut Butter product is intended to be consumed by children. In fact, The SoyNut Butter Company specifically markets this product as a ‘safe’ alternative to peanut butter for children with peanut allergies. Second, like peanut butter, SoyNut Butter is usually not cooked before it is eaten. So, when SoyNut Butter is spread on a child’s sandwich, there’s no opportunity for high temperature cooking to kill the E. coli bacteria,” says Jory D. Lange, Jr., a partner at Robins Cloud LLP, a nationwide law firm representing victims of defective products and foodborne illnesses. The firm is providing free, no-obligation legal consultations to the sickened adults and families whose children may have been harmed.
Mr. Lange also added, “The company markets its ‘I.M. Healthy’ SoyNut Butter to parents who are trying to give their children an everyday ordinary experience—enjoying a sandwich like any other child—in a way that is safe for children with peanut allergies. But the SoyNut Butter Company’s product may be contaminated with highly infectious E. coli bacteria."
Robins Cloud LLP is currently investigating the details of an outbreak linked to The SoyNut Butter Company’s products.
Following the announcement of the link, The SoyNut Butter Company initiated a recall of its I.M. Healthy Original Creamy SoyNut Butter. Company representatives have stated that they decided to recall its soy nut butter products after the FDA contacted them about “a possible link between our product and illnesses regarding E. coli.” The CDC, FDA, local government agencies, and the company urge the public to immediately stop eating the affected product.
The company’s website represents that their products are served to “over 2 million children a month ... [i]n everything from schools to daycare facilities, camps and Head Start programs, the remarkably similar taste and texture of our SoyNut Butter is a hit with kids of all ages.” This is especially concerning as children, along with the elderly and those with compromised immune systems, are at the highest risk to develop HUS and further severe complications as a result of eating E. coli O157 contaminated food. Regardless of age, if you or your family have ingested SoyNut Butter Company products or I.M. Healthy SoyNut Butter and are showing any of the signs or symptoms of E. coli food poisoning, you should seek immediate medical.
Those who suffered injury and complications allegedly related to foodborne illness from eating products from The SoyNut Butter Company may be entitled to compensation for injury-related damages. To learn more about making a claim, please visit Robins Cloud LLP's website, or call (855) 969-5637.
